The following Conditions of Sale govern the offer and sale of products on saraceniwines.com. Products purchased on saraceniwines.com are sold directly by LOMA BRANDS S.r.l. (the "Vendor"), with registered offices in Italy at via G. Silvani 126, 50125, Florence, VAT number 06306230480, Reg. Imprese di Firenze REA FI-617615.

This notice contains the legal terms and conditions that govern the website, saraceniwines.com. Users of saraceniwines.com accept and agree to respect all the conditions included in this declaration. If Users do not accept these terms, LOMA BRANDS S.r.l. reserves the right to ask the Users to refrain from using the website saraceniwines.com.

1. Our business policy

The Vendor offers products for sale on saraceniwines.com and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers". "Consumer" shall mean any individual who is acting on saraceniwines.com for purposes which are outside his or her trade, business or profession. The Vendor reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Vendor's Terms & Conditions included in this declaration. These Conditions of Sale govern the offer, transmission, and acceptance of purchase orders relating to products on saraceniwines.com between the users of saraceniwines.com and the Vendor.

2. Age requirements

You must be 21 years of age to buy alcohol from saraceniwines.com. By using this site you swear and affirm and represent to us that you are over the legal age required to buy alcoholic beverages and products and we will rely upon this representation because if we are held liable for any reason if that is not true, you agree to indemnify us and/or reimburse us and be responsible for all costs, expenses (including legal fees) and damages we suffer or incur. We make every effort to ensure that alcoholic beverages are not sold or delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from us is over the age of 21. You also agree that any alcohol purchased from us is intended for personal consumption and not for resale. If you cannot make these affirmations and representations or you do not agree with all of these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to obtain or provide alcohol to a person under the age of 21, we will report this to the appropriate authorities and prosecute you fully to the extent allowable by law.

3. Minimum order

Every order has to be 3 or above. You may mix and match wines and olive oil as long as the total number of bottles you order is minimum 3.

4. Customer service

First and foremost, if you order wine from us you are representing to us that you are of legal drinking age and that the person to whom it is being shipped is also of legal drinking age. All packages sent out by saraceniwines.com may require an Adult Signature at the time of delivery. You can choose to ship to a business address or to a residential address, we will try delivering the package 3 consecutive business days. Orders are processed Monday through Friday. We cannot ship wine to PO Boxes or APO addresses.

5. Sales Conditions

All the products included in our shop are really available in our warehouse. Prices listed on the site are subject to variations and/or change by saraceniwines.com without any prior notice to the customer. Sales Contracts concluded prior to the publication of these changes, but not already shipped, will apply the prices prevailing at the time of the Order. Published prices of products may vary for different vintages and formats.

Title of Ownership: For all items purchased from SaraceniWines.com, title is passed to the purchaser in Italy. By placing an order with SaraceniWines.com, you expressly agree to assume title to the merchandise in Italy, immediately upon tendering full payment. All items must be paid for in full prior to arrangements for delivery. Saraceni Wines's performance obligation under the purchase agreement for the sale of wine is complete upon tender of the merchandise to a third party carrier for transportation and delivery. These Terms are governed by Italian law as well as any Contract of Sale are subject to the Italian jurisdiction. Any dispute relating to these Terms or the Contract of Sale will be under the exclusive jurisdiction of the Court of Firenze, not with standing the applicability of the mandatory law for the protection of consumers.

Many countries and states have laws regulating the shipment of wine into their jurisdiction and may limit the amount of wine that can enter the state without permits or licenses. By placing an order with saraceniwines.com, you are expressly representing and warranting that you have reviewed any pertinent local and state laws before purchasing wine on this website and that your purchase complies with all applicable local, state, and federal laws and regulations. Saraceni Wines makes no representation to the legality of shipping to any state outside of Italy and does not assume any responsibility for obtaining any necessary licenses or permits. Saraceni Wines does not, itself, provide shipping services. If you wish to have your purchase shipped, Saraceni Wines will contact a third party common carrier to ship on your behalf. Unfortunately, common carriers will not deliver alcohol to all states - those states have been removed from our shipping options at checkout. We apologize for any inconvenience this may cause. By arranging for transportation of alcoholic beverages by a third party carrier, Saraceni Wines is providing a service to, and acting on behalf of, you, as the purchaser and title holder of the products purchased. By asking Saraceni Wines to arrange for transportation and delivery on your behalf, you expressly represent and warrant that you are acting in compliance with applicable local, state, and federal laws regarding the purchase, transportation, and delivery of alcoholic beverages. You further represent and warrant that you have obtained any required permission, paid any required fees, are working through properly licensed intermediates where required, are legally entitled to take possession of the alcoholic beverages, are legally entitled to take the quantities ordered, will comply with any applicable tax laws, and that you and the person accepting delivery of the alcoholic beverages are at least 21 years of age.

6. Payment & currency

Based on your choice, payment will take place through the secure server of our partner PayPal, AmazonPay and Stripe. We will not know your credit card data since you will give them only to our partners. PayPal, Amazon and Stripe help protect your credit card information with industry-leading security and fraud prevention systems. saraceniwines.com process all orders in USD ($).

7. Order tracking

You can find the tracking number to monitor online the shipping status directly on your "Account" page. Anyway, if you ever have any questions or concerns regarding the tracking of an order, please email — tracking@fratellisaraceni.com

8. Availability

All orders are subject to product availability. In the event that we have run out of an item on your order, we will contact you to arrange for a replacement. If the replacement options or the new delivery schedule is not acceptable, you may cancel the order for a complete refund. 

9. Cancellation policy

If you wish to cancel a recently placed order, we will do everything possible to honor your request. However, once your order has been submitted to our fulfillment facility and is being processed or already shipped out, it cannot be canceled or revised.

10. Promotion code & coupons

In order to redeem a Promotion Code or Coupon, enter the code in the Offer Code box within the 'Checkout' page and click 'Submit' to recalculate your Total. Only one promotion code can be used per order. Each code/coupon is one use per customer. Some brands or products may not be included, such as limited editions, signed bottles, and promotional items.
